How much time and MONEY are you gonna spend trying to get this guy to court when he stops payin. Or maybe you don't want insurance seeing the videos and think that something else was going on pre-prang?
Felix Posted September 9, 2009 Report Posted September 9, 2009 (edited) To go through insurance the other guy needs to be covered or Evan needs comprehensive (unless he has 3rd party coverage where his company will cover him if the other guy is uninsured). If the insurer is not a specialist insurer you will only get that, you will not get what it might be worth based on its good condition. 3. Draw up an agreement with him at $200 per payment 4. You only need to get four payments out of him and you are ahead of what you would have got from insurance, so PROFIT!!! And you get to keep your car. I wouldn't necessarily agree with private agreements because really it is not worth the paper it is written on so you are going to have to make a judgement call as to whether you think he is legit. Just my 2 cents, not that they are a coin anymore :worship: Plenty of people will give you advice, so you need to take it all in and decide what is right for you I had a situation where a lady ran into the back of my car while my wife was driving. The other driver (not my wife) ran a red light so she was clearly in the wrong. I wanted choice of repairer which I figured I wouldn't get through her insurance so I gave her 1 day to come up with the money for the repairs or I was going to report it to the police (meaning a possible fine for running the red light) and also a mark on her insurance. She came up with the $1K within a day and all was settled and I arranged the repairs privately. Her car had barely a scratch on it so she didn't worry about it. /rant

From what you've described it seems as if you didn't come into contact the other car at all. Unless you've got witnesses or an admission of guilt from the other party you might get screwed. Not hard for them to claim not knowing anything about it and that you were driving like a knob and put your car into a pole. Especially if they see the youtube video (ps take it down it's shithouse)

This could also result in more harm to you or your car and its hard to know what to do in that split second you get to react :worship:

I have always drummed into her to never swerve in an emergency unless you have ample time to assess the situation and safely do so. Cars are designed to take the impact better head on. She hit the other car dead center and the car took most of the force. It was still pretty brutal but I believe it would have been worse to swerve off the road at 100km/h ... just one of those things you sometimes learn the hard way. Unless you had full comp for agreed value, I'd just go with the $200 payments and see how it goes. If they stop paying unfortunately it wouldn't be worth chasing :jamie:
Evan G Posted September 10, 2009 Author Report Posted September 10, 2009 yea i go for insurance and get $400 for my car and probs to buy it back will be $700? police reports were done , he admited he ran the red etc etc.. on the way home with the ke55 on the tow truck, the tow truck driver said "your lucky mate, in this area no c**t stops if theres a accendent" ive made a contract were theres gonna be 2 witness's and he agrees to pay 150 to 200 a week and a log will be filled out and signed by both parties. the bloke just lives dead set 2 mins by foot. we both agreed not to get insurance involved , he doesnt pay premium and doesnt lose his rating 1. i keep my wrecked car and get paided out $1750. everyone is happy ???/

Hey mate not to get to off topic but i had a mate that crashed his car on the highway at a 110km/h and he swerved to miss something in the road and took out about 500m of that wired guard rail in the middle of the M1 and completely wrote the dual cab ute off in the drivers side very lucky to live and had 4 other mates in the car was not a pretty picture at all And good to see you got the arrangements with the guy sorted Edited September 10, 2009 by Undertaker_is_the_best
